Insights from August 2015 EB-5 Stakeholder Meeting

The USCIS reported recently that there have been a significant increases in I-526, I-829 and I-924 petitions from October 31, 2014 through June 30, 2015. The increases are attributed by USCIS to the widespread awareness of the expiration of the EB-5 Regional Center program scheduled for September 30th. Other items of interest reported in the meeting included clarifications on the following:

Material changes on I-526 petitions. The policy continues to be that any material changes at any time after filing will result in the application being rejected. New Commercial Enterprises: The Immigrant Investor Program Office favors linking individual I-526 petitions and other applicable documents to the same, approved NCE will result in improved efficiency in adjudication and processing times. Regional Center regulation: A standalone team is being created to clarify Regional Center regulations and to ensure authenticity and compliance. Retrogression: The agency is monitoring the impact, if any, of retrogression on job creation timing parameters. – See more at:
