USCIS Offers Guidance for EB-5 Job Creation Requirements

On August 10th, the USCIS offered draft guidance to Congress in preparation of their upcoming review of the EB-5 program and to its job creation requirements in particular.

“Because employment in some industries, such as construction or tourism, can be intermittent, temporary, seasonal or transient, USCIS will continue to instruct officers not to exclude jobs simply because they fall into such industries.”
